Ratings & Review Terms of Use

These Terms of Use govern your conduct associated with the Customer Ratings and Reviews ("Reviews") feature offered by Behr Process Corporation on www.Behr.com (the "Behr Website"). The Guidelines for Reviews and Photo posted on the Behr Website are incorporated by reference in these Terms of Use. These Terms of Use are intended to supplement and be consistent with Behr's Privacy Policy and Behr's Website Terms (collectively "Behr's Terms and Policies"), all of which are incorporated by reference herein and which may be accessed by clicking on the links at the bottom of the home page of the Behr Website; however, to the extent of any conflict between Behr's Terms and Policies and these Terms of Use, these Terms of Use shall control with respect to the Reviews. By submitting any content to Behr Process Corporation, you represent and warrant that:

• you understand and consent to the Reviews you submit for posting on behr.com being shared with other websites, without limitation, all without notice to you;
• if you are an employee of Behr Process Corporation, Masterchem Industries, Masterchem Brands or Masco Corporation or any of Masco's affiliated companies, you have disclosed this connection in your Review;
• if you are an owner or employee of a retailer of any products of Behr Process Corporation, Masterchem Industries or Masterchem Brands, you have disclosed this connection in your Review;
• you are the sole author and owner of the intellectual property rights thereto;
• all "moral rights" that you may have in such content have been voluntarily waived by you;
• all content that you post is accurate;
• you are at least 18 years old;
• use of the content you supply does not violate these Terms of Use or Behr's Terms and Policies and will not cause injury to any person or entity; and
• you have not and are not entitled to receive any compensation in any form and from any party in connection with submitted content.

You further agree and warrant that you shall not submit any content:

• that is known by you to be false, inaccurate or misleading;
• that infringes any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;
• that violates any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising);
• that is, or may reasonably be considered to be, defamatory, libelous, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual, partnership or corporation;
• that is advertising or promotional material, including any "junk mail", "chain letter" or "spam" or any other similar solicitation;
• that impersonates or attempts to impersonate Behr Process Corporation or a Behr Process Corporation employee, another user, or person or entity (including, without limitation, the use of e-mail addresses associated with any of the foregoing);
• for which you were compensated or granted any consideration by any third party;
• that includes any information that references other websites, addresses, email addresses, contact information or phone numbers; or
• that contains any computer viruses, worms or other potentially damaging computer programs or files.
